HR debate rages over a case for constructive dismissal arising from a breach of social media policyA case in which an HR professional was disciplined for information he posted on his LinkedIn profile has sparked a debate in the HR community over how employers should respond to staff use of social networking sites.John Flexman resigned and claimed constructive dismissal after his former employer, gas firm BG Group, objected to data on his CV he’d uploaded to the social networking site. The company was allegedly unhappy over data showing how Flexman had reduced the company’s attrition rates, and also said he had breached their new social media policy by ticking a box suggesting he was interested in other “career opportunities”.We may never know the tribunal’s opinion on the case: the hearing overran its allotted time, was adjourned until May, and the parties could settle in the meantime. Ian Pettifer, a solicitor with Tayntons LLP, says staff in Flexman’s position face an “uphill battle” trying to prove constructive dismissal, although claims against especially heavy-handed employers have succeeded
